If You Have Been Denied Disability - Appeal

If you have been denied after filing for disability benefits and you disagree with the decision you have sixty days within which to appeal.  The time period that it will take to appeal is determined by each state.  So it depends on the state you live in.

First, a reconsideration hearing is scheduled in which the claimant’s case is heard at the state level.  If you disagree with the reconsideration hearing outcome then you can go before an Administrative Law Judge.  If you are still not satisfied with that decision the final appeal is heard by an appeals council.  Filing for disability benefits can lead to a long appeals process.
